Thank you for being part of the HEYBABY INC. family (“Company”, “we”, “us”, or “our”). Since family is everything, we’re committed to protecting your personal information and right to privacy. Having said all that, when you visit our mobile application and use our services, you trust us with your personal information (again, we take this very seriously). In this privacy policy we describe our privacy policy and try to explain, in the clearest way possible, what information we collect, how we use it, and what rights you have in relation to it. Please take some time to read through it carefully. If there are terms in this privacy policy you don’t agree with, please discontinue use of our Apps and our services.

This privacy policy applies to all information we may collect, use, store, disclose and process through your access to or use of our websites, and/or mobile application, (“Apps”), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Services”). Please read this privacy policy carefully as it will help you make informed decisions about sharing your personal information with us.

This Privacy Policy applies to the Services. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services.

Some services may require their own unique privacy policy. If a particular service has its own privacy policy, then that policy —not this Privacy Policy—applies.

3. What Information We Collect

Information automatically collected

Topline: Some information – such as IP address and/or browser and device characteristics – is collected automatically when you use our services .

We automatically collect certain information when you visit, use or navigate the Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Apps and other technical information. This information is primarily needed to maintain the security and operation of our Apps, and for our internal analytics and reporting purposes.

Information collected through our Apps

We may collect information regarding your mobile device, push notifications, when you use our apps.

If you use our Apps and create an account, we may also collect the following information:

Location data with your consent
If you grant heybaby permission, our app will be able to collect your precise location so you can see other users in your set geographic limits. This location data is determined through the use of various methods, such as bluetooth, GPS, and Wi-Fi connections. Should you choose not to grant heybaby access to your location data, we will not collect it and you will be unable to view other members.

While our system is designed to delete data as outlined, we cannot ensure that all data will be deleted within a specific time frame due to technical constraints or temporary difficulties. But we will make every effort to follow and complete the process as previously stated.

Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include, but is not limited to:
  • Email Address
  • First Name
  • Username
  • ZIP/Postal Code, City
  • Gender Identity
  • Date of Birth
  • Sexual Preference
  • Family Status
  • Cookies and Usage Data
  • Photographs;
  • Locations and
  • Information associated with linked Social Media accounts, such as Instagram, Apple, or Facebook.
  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s camera, social media accounts, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.
  • Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.
  • Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Upon completing your account creation, you can review and edit all profile information by logging into your heybaby account. Name and DOB cannot be changed. If you granted heybaby access to your location, that is based on the longitude and latitude of your device and is not manually changeable. User-provided information and assets in your profile, like gender, sexual preferences, family plans, uploaded photographs, and similar, are collected to maximize your experience and potential success on the app (visible to other members who view your profile) and are the responsibility of the account holder to edit as needed.
Data Storage
By using the App, you acknowledge that we are a global and our Services operate through servers located in a number of countries around the world, including the United States. If you live in a country with data protection laws, the storage of your personal information may not provide you with the same protections as you enjoy in your country of residence.

Cookies
We may use cookies, log files, web beacons, device identifiers, advertising identifiers and similar tracking technologies, including those from third-party service providers like Google Analytics, Google Tag Manager, and other cloud-based tools, to automatically collect your preferences, performance data, and information about your web usage when you visit the Services. For example, we may collect your IP address, device and Internet service provider information, Web browser details and the address of any referring website. This may include collecting geolocation signals from your IP address or device settings to determine your location so that we may operate and personalize the Services for you, including to provide more relevant ads and search results.  We may also collect information about your online activity, such as pages viewed and interactions with other users. The Services are not designed to recognize or respond to “do not track” signals received from browsers. You can control the information collected by such tracking technologies or be alerted when cookies are sent by adjusting the settings on your Internet browser or devices, but such adjustments may affect or disable certain functionality of the Services. Geolocation Information
If you granted HeyBaby access to your location upon onboarding or via your device settings, the app will collect your precise location in order for you to see others in your set geographical limits. Other users will not see your exact location, only the town in which your device is located at the time of use. 

Should you wish to disable this permission and not grant heybaby access to your location, you can do so in your phone’s settings:

 Should You Contact Customer Support
If you contact our Customer Support team via direct email or via our Customer Service Platform, we will receive your email address along with any information provided in your correspondence. This also applies to user reports, whether you are reporting another member or another member is reporting you. We will maintain a record of these communications for up to 6 years after your account has been deleted.

4. How We Use Your Information

Topline: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, protect the vital interests of you, our users, or the public, and/or your consent.

We use personal information collected via our Apps and/or Services for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, protect the vital interests of you, our users, or the public, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

To facilitate account creation and logon process. If you choose to link your account with us to a third party account *(such as your Apple or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract. See the section below headed “HOW DO WE HANDLE YOUR SOCIAL LOGINS” for further information. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

Optimize and improve the Services.
We continually try to improve the Services based on the information and feedback we receive from you, including by optimizing the content on the Services.

Personalize the user experience.
We may use your information to measure engagement with the Services, and to understand how you and our other users interact with and use the Services and other resources we provide.

Improve customer service.
Your information helps us to more effectively develop the Services and respond to your support needs.

Moderation Practices
HeyBaby employs both humans and Ai for profile moderation purposes. Our moderators review all accounts/profiles to make sure they are in accordance with our Terms of Use and Community Guidelines. This moderation may include a review of photographs, text, user-to-user communications within the app, and any other user-provided data that is publicly viewable or exchanged on our platform. Should one of our moderators or automated systems determine a profile is not in compliance, we reserve the right to suspend, block, or permanently remove an account from the heybaby platform. Should you feel a moderation action was performed in error, you can contact our support team for further review.

Process transactions.
We may use the information you provide about yourself to fulfill your requests and service orders. We do not share this information with outside parties except to the extent necessary to provide the Services, fulfill orders, and related activities.

To send periodic emails.
The email address you provide through our account forms, will be used to send information and updates pertaining to the Services. It may also be used to respond to your inquiries or other requests. If you opt in to our mailing list, you may receive emails that include our news, updates, related product offerings and service information, and marketing material. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or you may contact us via the contact information below.

5. Will Your Information Be Shared with Anyone?

Topline: We share your information with our partners, service providers, contractors, agents and third party vendors as needed to fulfill Services. Please note that our partners may contact you as necessary to obtain additional information about you, facilitate any use of the Services, fulfill orders, or respond to a request you submit.We may also share information with your consent, to comply with laws, provide you with services, protect your rights, protect the vital interests of you, our users, or the public, or fulfill business obligations. 

We may process or share data based on the following legal basis:

Consent:
We may process your data if you have given us specific consent to use your personal information in a specific purpose.

Legal Obligations:
We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements); to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us.

Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.  When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, interests, or safety of our company or the Services, our customers, or others; or in connection with our Terms of Service and other agreements.

Legitimate Interests:
We may process your data when it is reasonably necessary to achieve our legitimate business interests.

Performance of a Contract:
Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

More specifically, we may need to process your data or share your personal information in the following situations:

Vendors, Consultants and Other Third-Party Service Providers.
We may share your data with third party vendors, business analytics companies, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Apps, which will enable them to collect data about how you interact with the Apps over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. We may also authorize third-party vendors to collect information on our behalf, including as necessary to operate features of the Services, facilitate the delivery of orders, or provide online advertising tailored to your interests (as more fully described below). Third-party vendors have access to and may collect personal information only as needed to perform their functions, may only use personal information consistent with this privacy policy and other appropriate confidentiality and security measures, and are not permitted to share or use the information for any other purpose. Unless described in this privacy policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

Business Transfers.
We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Third-Party Advertisers. We may use third-party advertising companies, including Facebook to serve you targeted ads online. These companies may collect or receive specific types of information about your visits to our website(s) and other websites that are contained in web cookies, web beacons, and other storage tracking technologies in order to provide targeted advertisements about goods and services of interest to you. Other Users. When you share personal information (for example, by posting comments, contributions or other content to the Apps) or otherwise interact with public areas of the Apps, such personal information may be viewed by all users and may be publicly distributed outside the Apps in perpetuity. Accordingly, you assume full responsibility for posting such information and agree that we are not responsible in any way for personal information you choose to post in these public areas. If you interact with other users of our Apps and register through a social network (such as Facebook), your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Apps, and view your profile.

Aggregated Information. We may publish, share, distribute, or disclose personal information that has been aggregated with information from other users or otherwise de-identified in a manner that does not allow such data about you to be separated from the aggregate data and identified as originating from you, to third parties, including our partners, sponsors, and advertisers. Such information may help us identify and analyze training, demographic, and psychographic trends and information, and report to third parties how many people saw, visited, or clicked on certain content, areas of the Services, ads, or other materials. We may also use such data for research purposes.

6. How We Handle Your Social Logins

Topline: If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

Our Apps offer you the ability to register and login using your third party social media account details (like Facebook). Where you choose to do this, we will receive certain profile information about you from your social media provider and your profile with us will be available to all of our users whether via our Apps or our partners' websites.. The profile Information we receive may vary depending on the social media provider concerned, but will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public.

We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the Apps or through the Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third party social media provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

If you have registered on one of these third party websites (like Facebook), or you have verified your account via a third party website, we may connect your profile with us with your profile on such website. We may do this by way of new products and applications which we introduce from time to time.

7. How Long We Keep Your Information

Topline: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements) and for a commercially reasonable time thereafter for backup, archival, fraud prevention or detection or audit purposes. No purpose in this policy will require us keeping your personal information for longer than 6 months past the termination of the user's account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Attention Regarding Your Data After Account Deletion 
Information you choose to share on your profile is viewable to others in your search parameters. Even after you edit account information, that information may have been stored by others. We can not control this nor do we accept any liability for this. When you grant third party applications or websites access to personal data, they may retain such data to the extent outlined in their respective privacy and usage policies. 

8. How We Keep Your Information Safe

Topline: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process.
For example:
  • we transmit data over secured communication channels using SSL Login credentials,
  • all personal information is stored by trusted third party providers (e.g., AWS, Heroku, Google Firebase),
  • all systems used to provide the Services are password protected, and
  • all Services usage is restricted on a per-user basis on the principle of least privilege.
However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Apps is at your own risk. You should only access the services within a secure environment.

We comply with applicable data protection laws, including applicable security breach notification requirements.

9. Do We Collect Information from Minors

Topline: We do not knowingly collect data from or market to children under 18 years of age.

The Services are not directed to children, and you may not use the Services or provide any personal information to us if you are under the age of 18 or if you are not old enough to consent to the processing of your personal information in your country. By using the Apps, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Apps. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 10. What are Your Privacy Rights?

In Short: You may review, change, or terminate your account at any time.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. Account Information
If you would at any time like to review or change the information in your account or terminate your account, you can: Log into your account settings and update your user account or contacting us by other means set forth below.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements and/or as otherwise set forth in this privacy policy.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may: Access your account settings and update preferences.

Data Transfer. Our databases are currently located in the United States. We make no claim that our Apps and/or Services are appropriate or lawful for use or access outside the United States. If you access the Apps and/or Services from outside the United States, you are consenting to the transfer of your personal information from your location to the United States. You are solely responsible for complying with all local laws, rules and regulations regarding online conduct and access to the Apps and/or Services. By sending us your information, you further consent to its storage within the United States.

11. Controls for Do-not-track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

12. Do California Residents Have Specific Privacy Rights?

Topline: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us or otherwise using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Apps, you have the right to request removal of unwanted data that you publicly post on the Apps. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Apps, but please be aware that the data may not be completely or comprehensively removed from our systems.

13. Do We Make Updates to This Policy?

Topline: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.

14. Security

We pride ourselves on taking commercially reasonable security measures to help protect your information against loss, misuse and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

Unfortunately, no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur, but here are some handy tips to help keep your data secure:
  • Please make sure you log out of your Account after use.
  • Please don't share your social media password with anyone else.
  • Change your social media password periodically.
If you ever think someone has had access to your social media password, please report it to the relevant social media platform and change your password immediately. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.
